Standard Evictions Can Now Proceed!
The California statute defines “COVID-19 recovery period rental debt” as rental debt of a tenant under a tenancy that came due between October 1, 2021, and March 31, 2022. Rental debt that became due during this time was subject to numerous requirements. One of the main requirements is that landlords are required to apply for rental relief through the state. Additionally, a prerequisite to obtaining a default judgment requires the rental relief agency to provide a denial of the application. In most cases the rent relief agency would not issue a denial of the application, even if the tenant did not participate. The agency would only state that the application is “pending”. On this basis a default judgment could not be obtained.
However, this requirement only pertained to residential real property for unlawful detainers on or after October 1, 2021, and before March 31, 2022. As such, commencing April 1, 2022, a standard 3 Day Notice to Pay Rent or Quit can be served. If your tenant fails to pay within the 3-day period, an eviction action can be promptly filed. The requirement to apply for rent relief and obtain a denial does not extend past March 31, 2022. You should still apply for rent relief for the previous months. However, for rent owed beginning April 1, 2022 and thereafter, you should serve a 3-day notice to pay rent or quit as many of the limitations on evictions have been lifted.
