California voters passed Proposition 13 in 1978 to ensure voters – not politicians – have the final say on new taxes. Court rulings later created a loophole that allows local politicians and special interests to impose certain local taxes with a simple majority instead of the two-thirds vote the people intended. In the past decade alone, more than 2,000 new or higher local taxes have been enacted, even as Californians already pay the nation’s highest state income tax and highest statewide sales tax.
Prop 43 closes that loophole and restores the taxpayer safeguards Californians originally approved under Proposition 13.
Among its key protections, Prop 43:
- Reinstates the two-thirds vote requirement for local special taxes, including sales, parcel, electricity, and gas taxes.
- Guarantees taxpayers the right to vote on ALL new or higher local taxes.
- Restores the taxpayer protections voters originally put in place under Proposition 13.
- Shields homeowners, renters, and small businesses from expensive new real estate tax schemes.
